Desperate Democrats Label Coney-Barrett Confirmation as Court Packing

(RightWing.org) – When a word or a term doesn’t fit a definition, just change it. That’s what Democratic nominee Joe Biden and his fellow Democrats did over the weekend. They accused President Donald Trump and Senate Republicans of “packing” the Supreme Court.

On Monday, October 12, the Senate Judiciary Committee started the confirmation process to recommend Judge Amy Coney Barrett to the Supreme Court. The committee hopes to recommend her for a full vote by the Senate in approximately 10 days.

Democrats are in despair. Somehow, they have to find a way to derail Barrett’s nomination or risk losing the court and potentially their liberal agenda for a generation. It’s gotten to the point of folly. The situation is so desperate they are now redefining the meaning of words.

Democrats Trample the Constitution

On Saturday, October 10, Joe Biden refused to say again if he’ll pack the Supreme Court if he wins the election in a few weeks. While playing the game of “you have to elect me to find out what I’m going to do,” the former vice president tried to turn the issue on Republicans.

The Democratic nominee said, “The only court-packing going on right now is going on with Republicans… It’s not constitutional what they’re doing.”

Biden was referring to the Supreme Court confirmation hearing of Barrett. President Trump nominated the current judge who sits on the 7th Circuit Court of Appeals after the passing of Justice Ruth Bader Ginsburg created a vacancy in the court.

On Sunday, Sen. Chris Coons (D-DE) said the push to confirm Barrett “constitutes court-packing.”

Democrats are attempting to persuade the public that a Supreme Court justice should not be confirmed until a new president is elected, and any attempt to do otherwise is illegitimate. They say voters should have their voices heard. However, voters did have their voices heard when they voted for President Trump and their respective senators. The Constitution does not say their authority ends before their terms expire.

On Sunday, Sen. Minority Leader Chuck Schumer (D-NY) said Democrats will not appear in the Senate Judiciary Committee to prevent the Republicans from voting her out to the full Senate floor on October 22. However, there are multiple ways for Republicans to procedurally get around the Democrat’s grandstanding.

What Is Court Packing?

Court packing is the legal process whereby the Congress passes a law creating more Supreme Court seats, and the party in power “packs” those seats with judges that lean in their direction. Democrats are threatening to politicize the court by adding enough seats and confirming enough liberal judges to outvote the conservative ones.

The biggest political issues for Democrats right now is abortion and Obamacare. Strict constitutional justices who interpret the Constitution to mean what it says could overturn both issues, giving a major defeat to liberals.

Reality Sets In

The hearings this week may be contentious. There are questions about how hard Democrats will attack Judge Barrett. If they go too far, it could hurt them with independent voters. If they don’t go far enough, their liberal base could get angry and turn on them.

The reality is the Democrats are helpless to stop the confirmation. It appears the Republicans have at least the 51 votes required to confirm Barrett as a Supreme Court Justice.

The big unknown is how the hearings will impact the election. It will dominate a full week of the campaign with little more than three weeks to go until the big day.
